Oneidas Moving Cigarette Manufacturing Operations to Oneida; Creating Local Jobs - 8/25/10The Oneida Indian Nation is moving its cigarette manufacturing plant from Buffalo to Oneida, N.Y. The move will create 15 manufacturing jobs here in Central New York, and it will ensure that the loyal customers of the Nation's enterprises are able to continue buying Nation-manufactured cigarettes at reasonable prices, free from New York State taxes. By moving the plant to the Oneida homelands, the Nation is availing itself of a long-settled law that recognizes the right of Indian tribes to sell products they manufacture on their own reservations without interference from state tax laws. When an Indian nation manufactures its own products on its reservation, and sells those products on its reservation, federal law preempts state efforts to tax those products. The Nation purchased Sovereign Tobacco, its tobacco company, about two years ago. The cigarettes manufactured in the Oneida plant are Niagara's and Bishop brand cigarettes. They will continue to be sold at the Nation's chain of SavOn stores in Oneida and Madison counties and at selected retail shops at Turning Stone Resort and Casino, without state taxes on them.
