Statement Regarding Inapplicability of State’s Announcement to Oneida Indian Nation - 7/15/11

“The matters discussed today do not relate to the Oneida Indian Nation. Federal law completely preempts state efforts to tax any products, including cigarettes, which are manufactured and sold by an Indian nation on its own reservation. The State is aware that the Nation continues to sell its own brands – Niagara’s, Bishop, Great Country and Cool Harbor – in all of its own stores, including its SāvOn Convenience Stores and Turning Stone Resort Casino. Additionally, the Nation continues to sell off its existing inventory of non-Indian national brands while supplies last. To the extent the State directs its efforts at non-Indian manufacturers or sellers, the Oneida Nation government does not interfere with other governments’ affairs.”
